Date: Mon, 27 Feb 1989 12:20:00 -0500 1995-181 Commercial Metals Company ORDINANCE NO. 10315 AN ORDINANCE CLOSING AND ABANDONING TERMINAL ROAD LOCATED NORTHWEST OF HUDSON ROAD, NORTHWEST OF PINEVILLE ROAD, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Terminal Road located northwest of Hudson Road, northwest of Pineville Road, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Part of Terminal Road, a 50 foot wide right-of-way. To find the true point of beginning of said part of street, start at the intersection of the northeast line of Terminal Road with the northwest line of Hudson Road, thence northwest and northeast some 1922.82 feet with the northeast and southeast line of Terminal Road to the centerline (if extended) of a proposed cul-de-sac (having a radius of 50 feet), the true point of beginning, thence continuing northeast some 151 feet with Terminal Road to the beginning of the existing cul-de-sac (having a radius of 50 feet), thence northeast, northwest, and southwest 235.62 feet with said existing cul-de-sac to the northwest line of Terminal Road, thence southwest some 150.67 feet with Terminal Road to the northeast line of said proposed cul-de-sac, thence southeast and southwest some 78.54 feet with said proposed cul-de-sac to the southeast line of Terminal Road, the true point of beginning. Tax Map No. 126I-A-3 and 3.1. 0C SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for Jupiter Industries, Inc., d/b/a Chattanooga Gas Company, of an easement the width of the streets for its gas main, lines and other distribution facilities located within the petitioned rights-of-way, which must be maintained for the use and benefit of its customers. 2. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 3. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 4. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 5. The areas reserved for utility easements must be kept free and clear of all structures. 6. All existing easements are retained. SECTION 3.
